Dear Mr. Chairman:

As you know, Engineering Lift Truck Service has continued, over the last
eight years, to operate in a fashion inconsistent with the state and local 
laws, by-laws and regulations. Documentation regarding this problem has 
been furnished to you.  Numerous Town agencies have extensive documentation 
on this matter and businesses operating in this locus.  My complaints have 
generated substantial controversy, but the office of the Building Inspector 
has been totally ineffective in resolving this matter and the observed 
violations continue unabated.
    
I wrote to you on June 21, 1997 concerning the foregoing.  I have received 
no response from you or any other member of the Board of Selectmen.  I 
believe that it is your moral, legal and civil obligation to cause to 
enforce the various laws and by-laws of the Town of Billerica and the 
Commonwealth, and clearly, to ensure my civil rights.  It is not my intent 
to resolve these complaints of civil rights violations, lack of 
zoning/building code compliance and/or criminal misconduct in the courts.  
However, the Town of Billerica's inability to bring about lasting and 
effective compliance with legislative requirements begs this alternative. 

Again, would you please place this matter before the entire Board of 
Selectmen for a vote to cause an investigation to commence with a goal to 
remedy these problems now and in the future.

I would also renew my request to be apprised, on a monthly basis, in
writing, of: 
 1) The actions of the Board of Selectmen, 
 2) The progress of any potential investigation, and  
 3) The substance of the remedial actions taken.
